Terms of Service
Este documento está disponible en italiano y en inglés: a continuación se muestra la versión en inglés.
1. Who we are
Etichettalo is an online service provided by Erik Piccinini, sole proprietorship with registered office at Via Beniamino Gigli 15, 62011 Cingoli (MC), VAT number 02020330433, REA MC-260897 ("we"). You can write to us at [email protected].
These terms govern the use of the service by the business or professional who creates an account ("you" or "the customer"). By creating an account you accept them on behalf of the organisation you represent.
2. Who it is for
The service is reserved for businesses and professionals using it for their work: food businesses, consultants, food technologists and firms. It is not intended for consumers.
3. What the service does
Etichettalo helps you prepare the mandatory information on food labels from your recipes: ingredient list, allergens, quantitative ingredient declaration (QUID), nutrition declaration and statements, for the markets and languages you choose. It lets you keep approved versions, export them and publish catalogues.
4. You remain responsible for the label
The service is a support tool. Under Article 8 of Regulation (EU) No 1169/2011, responsibility for food information lies with the food business operator under whose name the product is marketed.
- Calculations depend on the data you enter (recipes, quantities, weight loss, nutrition values, suppliers' allergens).
- Values taken from reference databases are indicative averages and must be checked against your products.
- You must check every label before printing it. The service's warnings help, but they do not replace the review of someone who knows the product and the rules.
5. Accounts and security
Each person uses their own account. You must keep your credentials safe, turn on two-step verification when your organisation requires it and tell us at once if you suspect unauthorised access. The organisation owner decides whom to invite and with which role.
6. Free trial
The trial lasts 7 days, requires no credit card and includes an example product. When the trial ends the organisation stays available read-only until you choose a paid plan.
7. Plans, prices and payments
- The plans, prices and limits that apply are those published on the website and on the Plan page of the app at the time of purchase.
- You pay in advance, monthly or yearly, through Stripe. We do not store your card details.
- Subscriptions renew automatically at the end of each period unless cancelled.
- You can cancel at any time from the Plan page: the subscription stays active until the end of the period already paid and does not renew. Except where the law provides otherwise, periods already started are not refunded.
- We may change prices with at least 30 days' notice by email. The new price applies from the next renewal and you may cancel before it takes effect.
8. Your data and content
Recipes, ingredients, specification sheets, labels and files you upload remain yours. You only grant us the right to process them to provide the service (calculate, store, export, and publish the catalogues you choose to make public).
You can export all of your organisation's data at any time from Settings › Data and privacy. If you ask us to delete the organisation, its data can be recovered for 30 days and is then erased, together with its files.
For personal data contained in your content (for example the names of colleagues or client companies) we act as a processor on your behalf, under the agreement in section 9.
9. Processing data on your behalf
For personal data you enter in the service you are the controller and we are the processor, under Article 28 of Regulation (EU) 2016/679. We undertake to:
- process it only to provide the service and according to your instructions, which are these terms and the choices you make in the app;
- bind authorised persons to confidentiality;
- apply appropriate security measures: encrypted connections, isolation of each organisation's data, backups, activity log;
- use only the sub-processors listed in the privacy policy, telling you before adding new ones;
- help you answer data subjects' requests and notify you without undue delay of a personal data breach;
- erase the data when the service ends, as described in section 8.
10. Acceptable use
You may not use the service for unlawful purposes, upload content that infringes third-party rights, try to access other organisations' data, circumvent plan limits or overload the service with automated requests.
11. Availability
We do our best to keep the service available at all times, but interruptions may occur for maintenance or for reasons beyond our control. Planned work is announced when possible.
12. Limitation of liability
To the extent permitted by law, and except for wilful misconduct or gross negligence, we are not liable for indirect damage (for example lost profit or product recalls) and our total liability does not exceed what you paid us in the 12 months before the event.
13. Suspension and closure
We may suspend an account for non-payment or a serious breach of these terms, notifying you when possible. You can close your organisation at any time as described in section 8.
14. Changes to these terms
We may update these terms. Material changes are notified by email at least 30 days in advance. If you do not accept them you may cancel before they take effect.
15. Governing law and jurisdiction
These terms are governed by Italian law. The courts of Macerata have exclusive jurisdiction over any dispute.
